Consent Agenda

Minutes of previous meeting

The OPSEU Executive Committee adopted the OPSEU Executive Committee minutes of February 24, 2021 web conference and March 4, 2021 E-poll

March 4, 2021 E-poll: Pay Equity Coalition Judicial Review

Moved by Thomas/Almeida

Whereas the Pay Equity Hearings Tribunal (PEHT) ruled in a decision in 2019 that unions do not have the right under the Pay Equity Act to negotiate pay equity maintenance on behalf of their members; and

Whereas the PEHT decision will apply to unionized workplaces across Ontario, and will restrict efforts by OPSEU/SEFPO to achieve pay equity for members; and

Whereas ONA was a party to the PEHT decision, and has filed an application for judicial review, which is scheduled to be heard on two days in May 2021; and

Whereas the Equal Pay Coalition was formed in 1976 by women’s groups, trade unions and community organizations in an effort to end gender pay discrimination and close the gender pay gap; and

Whereas the Equal Pay Coalition has intervened in the judicial review application filed by ONA, and will incur legal costs estimated at $50,000 or more; and

Whereas the Equal Pay Coalition has requested funding assistance from the OFL, and to date three affiliates have committed funding of $10,000 for legal costs;

Therefore be it resolved that OPSEU/SEFPO provide funding of $10,000 for legal costs incurred by the Equal Pay Coalition in the course of intervening in the judicial review filed by ONA, with funds to be drawn from the contingency fund.
